Suruhanjaya Tenaga : “Our conclusion is that you go and negotiate with TNB.”
Mr. Wong : “Okay.”
TNB : “So you want to pay or not? We can negotiate one.”
Mr. Wong : “I am not going to pay anything!”
TNB : “So you don’t want to negotiate?”
Mr. Wong : “I come here to negotiate but I am not going to pay anything.”
TNB : “Then there is nothing to negotiate lor. We go cut power lor.”
Mr. Wong : “I go and make police report.”
TNB : “You go and make lor. We got power to cut your power one. We not sked.”

Dr. X : “Wei! WTF my clinic power got cut?”
Mr. Wong : “It’s not my fault! I complained to BPA, ST and even made police report!”
Dr. X : “I rent shop from you and now I don’t have power! You get my power back or I am going to move out!”
Mr. Wong : “Wei wei wei! Dun la lidat! We are on the same boat here! I am doing all I can!”
Dr. X : “You want to sink you sink alone! I go swim somewhere else.”

Dr. Liew : “Let me call up Suruhanjaya Tenaga.”
Suruhanjaya Tenaga : “Mr. Wong should negotiate with TNB.”
Dr. Liew : “But they are asking Mr. Wong to pay. Mr. Wong doesn’t want to pay.”
Suruhanjaya Tenaga : “Then bring to court lor.”
Dr. Liew : “Any other option?”
Suruhanjaya Tenaga : “Can rent our generator set. Veli cheap only! Hehehe.”
Dr. Liew : “Fuck you!”
Mr. Wong : “I tell you hor… This ST and TNB snake rat one nest one…”
Dr. Liew : “Wait I call TNB CEO Che Khalib.”
Sexcretary : “Boss busy. I pass you to his special officer (SO aka Ass’Ole).”
Ass’Ole : “I will consult with my boss.”
Dr. Liew : “Call me back.”
Ass’Ole : “My boss say you should ask Mr. Wong to negotiate.”

Miss Yong : “I can represent Mr. Wong. TNB is known to use this kind of tactic. I will write them letter.”
Dr. X : “Wei wei wei! What about me? My patients are dying left right center out there!!!”
Miss Yong : “Since this case is between Mr. Wong and TNB, you can go to TNB and ask them to open another account under your own name.”
Dr. Liew : “Will they allow another account to be opened at the same address while there’s an MYR 20k lawsuit pending?”
Miss Yong : “I am sure they can. But whether they want to do it or not is another matter.”
Dr. Liew : “Oi! Ass’Ole! Can Dr. X open a new account with TNB while waiting for Mr. Wong and TNB to rot in hell?”
Ass’Ole : “I also dunno. I am not very well-versed with this.”
Dr. Liew : “Then can you suggest someone that is more well-versed than you?”
Ass’Ole : “It’s 5pm. I will try to get Puan K of TNB to call you back today if I can get hold of her, or tomorrow.”

Dr X can always open a new account with TNB and TNB cannot reject. Full stop.
You see Tenanga has a monopoly over the supply of electricity and we cannot buy electricity from anyone else except TNB, so under the Supply of Electricity Act, TNB is under an obligationto supply electricity and TNB cannot reject application without good reason.
As a Tenant, Dr X is entitled to electricity supply and TNB is under obligation to supply to Dr X and TNB cannot use the dispute with the Landlord Mr Wong as an excuse to reject, because now the applicant is Dr X not Mr Wong. So get Mr Wong to use the Tenancy Agreement to apply for an account and if they reject escalate the issue and ask to see the Manager, and if the Manager reject, quote him the Electricity Act and remind them of thier obligation to supply, still reject, ask them for a written reason, usually at this point they will be very scared ! please keep us updated love your blog !
bcsoh1 : Thank you for your enlightment. Dr. X did try to talk to TNB. TNB say they have the right not to provide power supply to the same address. I will post up more of the path taken. Follow this blog closely.
bcsoh1 : Dr. X did bring out an example that if his clinic is running dialysis machine and his patients will be dying left right center if he doesn’t get his power back. But all he got was being asked to refer to TNB’s legal team. He had many appointments with his patients scheduled for tests or/and reports, which he could not deliver. All his patients who are supposed to get their refills for their anti-hypertensives are now in hospitals with stroke. Patients for regular dressings to their diabetic wounds now having their limbs rotting in hell. Let alone those uncles who couldn’t satisfy their wives without Viagra and their wives now looking for Banglas to satisfy their sexual needs. Now, whose fault is it? Pray tell!
Well legally TNB is wrong in not supplying electricity to Dr X. I have done many cases where the seller of a house has outstanding bill with TNB, when purchaser went to TNB to open new account the first reaction from the front person is to ask Purchaser to pay the bill or else reject the application, I always ask the purchaser to quote them the electricity act or asking them to confirm that TNB is rejecting their application, the front person will be taken aback by the response and after consulting with the manager the purchaser is always allowed to open new account without having to pay for the outstanding bill.
It seems that the Manager of that particular TNB shop is trying to give Dr X a hard time behaving like a little napolean, and I suspect that if this matter is escalated, his job might be on the line. So If they want to play big this matter i suggest you also play big with them: get a court order (Mandamus) to compel TNB to supply electricity to Dr X, definately win one, and Dr X will get back his legal cost (since it is High Court matter, Dr X will be awarded 5 figure court cost), loss of business income, and if can punitive damages (a bit difficult to get but who cares just ask the court to give la). All Dr X now needs is evidence that they refuse his application for supply of electricity, and money for legal fees, and Dr X can brag to all his friend about how he drag the mighty kuai lan TNB to court ….!

Nice information here… Can this be applied to Telekom also? (I think not since they are not “monopolizing” rite?)
How about the water supply company? (I forgot what name already but it’s in KL)
